New Decision in Navigability Case
The Oregon Court of Appeals issued its opinion in Hardy v. State Land Board, a case addressing whether a portion of the Rogue River is publicly or privately owned. In 2008, the State asserted ownership to the river channel as it existed in 1859, when Oregon became a state. Property owners, who hold record title to the same land, challenged the State and won in circuit court. On appeal, the court partly reversed that decision, concluding that the Rogue River was navigable for title purposes from Grants Pass upstream to the Lost Creek Dam. However, the court agreed that the State’s declaration of ownership was invalid. The property owners have petitioned the Oregon Supreme Court for review of the decision on navigability.
